
The company said its trademark was being infringed upon by Trader’s selling the cookie that is strikingly similar to the Milano cookies made by Pepperidge Farms.
In the lawsuit filed last week, Pepperidge Farm alleged that by selling its Crispy Cookies, the supermarket chain was damaging its goodwill as well as confusing shoppers.
While Pepperidge Farms has admitted that the Crispy Cookies have a more rectangular shape, the company noted an oval shape overall, adding that similar packaging was also used by Trader Joe’s
The lawsuit read that the acts by Trader Joe’s were calculated and malicious to injure Pepperidge Farm.

Trader Joe’s willfully sought to use the reputation of Pepperidge Farm and of its Milano cookies, the company stated in its complaint, which is seeking to half the sales of the cookies along with punitive and compensatory damages.
Pepperidge Farm, which first launched its Milano cookies back in 1956, is Norwalk, Connecticut based. Trader Joe’s has its base in Monrovia, California.
